Version in force as of 25 July 2026. Version 1.0.
Article 1 - Purpose and scope
These general terms and conditions of sale (hereinafter the "GTC") apply, without restriction or reservation, to all sales concluded by JET Company, operator of the website terrassexpert.com (hereinafter the "Seller" or "Terrass'Expert"), with any buyer (hereinafter the "Customer"), whether acting as a consumer, a non-professional or a professional.
The Seller markets products intended for the construction and fitting-out of terraces: adjustable pedestals and pedestal accessories, porcelain stoneware tiles and surfacing materials, finishing profiles, joists, fasteners and related accessories (hereinafter the "Products").
The GTC are accessible at any time on the website and prevail over any other document, in particular over the Customer's general terms of purchase. Placing an order implies full and complete acceptance of the GTC in force on the day of the order, expressed by ticking the box provided for this purpose during the ordering process.
The Seller reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date the order is validated, a copy of which is sent to the Customer with the order confirmation.

- Non-professional: any legal entity not acting for professional purposes.
- Professional: any natural or legal person, public or private, acting for purposes within the scope of their professional activity.

Article 4 - Products and availability
4.1 Characteristics. The essential characteristics of the Products (dimensions, material, load capacity, adjustment range, colour, packaging, weight) are presented on each product page, supplemented where applicable by the manufacturer's technical data sheets available for download. The Customer must read them before placing any order.
4.2 Tolerances and appearance. The photographs, visuals and videos illustrating the Products have no contractual value as regards the exact rendering of shades and textures. Porcelain stoneware, natural stone, wood and composite products naturally show variations in shade, veining and appearance from one production batch to another, as well as dimensional tolerances in accordance with the applicable standards (in particular NF EN 14411 for porcelain stoneware). These variations do not constitute a lack of conformity. The Customer is strongly advised to order all the quantities required for the same project at once in order to guarantee batch consistency, and to mix the pallets during installation.
4.3 Quantities and calculators. The quantity estimation tools made available on the Website (pedestal calculator, surface area estimate) provide an indicative order of magnitude, based on standard layout assumptions. They do not exempt the Customer from checking their measurements and taking into account the specific features of their site (cuts, complex shapes, slopes, special points). The Seller cannot be held liable for any surplus or shortfall in the quantity ordered.
4.4 Availability. Product offers are valid while stocks last, as specified when the order is placed. If a Product becomes totally or partially unavailable after the order has been placed, the Seller will inform the Customer by email as soon as possible and offer either a restocking lead time, an equivalent product, or a refund of the corresponding amount within a maximum of fourteen (14) days.
4.5 Spare parts. In accordance with Article L. 111-4 of the French Consumer Code (Code de la consommation), information on the availability of spare parts essential to the use of the Products is indicated on the relevant product page, where it has been provided by the manufacturer. If no such information is given, it has not been provided by the manufacturer.
Article 5 - Prices
5.1 Prices are shown in euros, including all taxes (incl. VAT) for consumer Customers, and excluding taxes (excl. VAT) where applicable for professional Customers with a dedicated account. They do not include delivery charges, which are calculated and displayed separately before the order is finally validated.
5.2 Value added tax. Prices include French VAT at the applicable rate (20% on the date of publication of these GTC). For deliveries to another European Union Member State to a private individual, the applicable VAT is that of the Member State of destination, in accordance with the One-Stop Shop (OSS) scheme; the applicable amount is shown in the order summary. For VAT-registered professional Customers established in another Member State who provide a valid intra-Community VAT number, the delivery may be invoiced excluding VAT.
5.3 Eco-contribution. Some Products fall within the French extended producer responsibility scheme for construction products and materials for buildings (REP PMCB). Where applicable, the amount of the eco-contribution is included in the displayed price and shown separately on the invoice.
5.4 The Seller reserves the right to change its prices at any time. Products are invoiced on the basis of the prices in force at the time the order is recorded.
5.5 Obvious error. In the event of an obvious error in the displayed price (derisory price or price unrelated to the actual value of the Product), the Seller reserves the right to cancel the order and refund the Customer in full, after informing them.
Article 6 - Orders
6.1 Process. Orders are placed online via the Website's checkout process: selecting Products and adding them to the cart, checking the cart, entering or selecting billing and delivery addresses, choosing the delivery method, accepting these GTC, choosing the payment method, then final validation of payment. Validation of payment constitutes conclusion of the contract and entails an obligation to pay.
6.2 Verification. It is the Customer's responsibility to check the accuracy of their order at each step and to correct any error before validation. The Customer is solely responsible for the accuracy of the information provided, in particular the delivery address and the access constraints of the delivery location (see Article 9).
6.3 Confirmation. An email acknowledging receipt of the order and summarising its content is sent to the Customer without delay. The contract is only validly formed upon receipt of this acknowledgement and subject to the actual collection of payment.
6.4 Modification and cancellation. Any request to modify or cancel an order must be sent without delay to contact@terrassexpert.com. It can only be taken into account if the order has not yet been shipped. This option is without prejudice to the right of withdrawal provided for in Article 11.
6.5 Refusal of order. The Seller reserves the right to refuse or cancel any order that appears abnormal, that is placed by a Customer with whom there is a payment dispute, or in the event of suspected fraud.
6.6 Archiving. In accordance with Article L. 213-1 of the French Consumer Code, for orders of €120 or more, the Seller keeps the written record of the contract for ten (10) years from delivery and guarantees the Customer access to it upon simple request.
Article 7 - Payment
7.1 Accepted payment methods: bank card (CB, Visa, Mastercard), PayPal, bank transfer, payment in instalments. The price is payable in full on the day of the order, unless otherwise agreed in writing for professional Customers.
7.2 Security. Card payments are processed by approved payment service providers, in a secure environment and with strong cardholder authentication. The Seller never has access to the Customer's full bank details and does not store them.
7.3 Retention of title. In accordance with Article 2367 of the French Civil Code, the Products delivered remain the property of the Seller until full payment of the price. This clause does not prevent the transfer of risk provided for in Article 10.
7.4 Non-payment. If payment authorisation is refused, the order is automatically cancelled. For professional Customers, any late payment automatically and without prior formal notice gives rise to late payment penalties at the interest rate applied by the European Central Bank to its most recent refinancing operation plus 10 percentage points, as well as a fixed indemnity of €40 for recovery costs, in accordance with Article L. 441-10 of the French Commercial Code.
Article 8 - Delivery: areas and lead times
8.1 Areas. Deliveries are made in mainland France (including Corsica, subject to specific conditions and lead times) and in the European Union countries offered during the checkout process. Deliveries to the French overseas departments and territories (DROM-COM), islands not connected by a bridge and certain restricted-access areas are subject to a specific quotation on request.
8.2 Lead times. Preparation and shipping times are indicated on each product page and repeated when ordering. The lead times given are average lead times excluding Saturdays, Sundays and public holidays, running from validation of payment. In accordance with Article L. 216-1 of the French Consumer Code, unless otherwise stated, the Seller delivers the Products without undue delay and no later than thirty (30) days after conclusion of the contract.
8.3 Late delivery. If the stated delivery date is exceeded, the consumer Customer may, in accordance with Articles L. 216-6 and L. 216-7 of the French Consumer Code, require the Seller to deliver within a reasonable additional period and then, failing performance, terminate the contract by registered letter with acknowledgement of receipt or in writing on another durable medium. The contract is then considered terminated upon receipt of this notification, and the Seller refunds all sums paid no later than fourteen (14) days following the date of termination.
8.4 Shipping costs. Delivery charges are calculated according to the total weight, volume, method of transport and destination. They are displayed before the order is validated. The Seller may offer free shipping above an order threshold, under the conditions specified on the Website.
Article 9 - Delivery: terms and Customer obligations
Most of the Products sold are heavy, bulky and fragile goods, shipped on pallets by a palletised freight carrier or chartered transport. The following provisions are essential.
9.1 Accessibility. The Customer guarantees that the delivery location is accessible to a heavy goods vehicle (semi-trailer or rigid truck as the case may be) and has sufficient manoeuvring and unloading space. The Customer must report any access constraints when ordering (narrow street, one-way street, pedestrian zone, height restriction, unpaved track, time restrictions, regulated town centre). In the absence of information or in the event of incorrect information, the costs of re-presentation, return, storage or redelivery resulting from the failed delivery will be charged to the Customer.
9.2 Nature of the service. Unless expressly stated otherwise, delivery is made at the foot of the truck, at the property boundary, on a flat and stable surface. It does not include carrying, delivery upstairs, or placing the goods in the garden or at the installation site. Where the "tail-lift" option is available, it allows the pallet to be lowered to the ground from the truck bed, without any subsequent movement.
9.3 Appointment. For palletised shipments, the carrier contacts the Customer on the telephone number provided when ordering in order to agree on a delivery slot. The Customer undertakes to be reachable and available. If the Customer is absent at the agreed appointment, the costs of a new delivery attempt are borne by the Customer.
9.4 Unloading and handling. The Customer must be present, or be represented, at the time of delivery, and provide the manpower needed to handle the packages after they have been unloaded. The driver is not required to help move the goods beyond unloading.
9.5 Inspection on receipt - essential clause. The Customer must imperatively, in the presence of the driver and before signing the delivery note:
- check the number of packages and pallets delivered;
- open the protective film and check the apparent condition of the goods (cracked or chipped tiles, crushed pedestals, bent profiles, tipped-over or collapsed pallet);
- in the event of any anomaly, write precise, complete and detailed written reservations on the delivery note or the carrier's receipt (for example: "8 tiles broken on the front right corner of pallet 2 of 3") and have them countersigned by the driver. General statements such as "subject to unpacking", "damaged package" or "subject to reservation" have no legal value and will not allow the claim to be covered;
- photograph the goods, the pallet and the annotated delivery note.
The Customer may also refuse all or part of a delivery that is obviously damaged, stating this precisely on the delivery note.
9.6 Notification to the Seller. The Customer informs the Seller of any anomaly found, enclosing the annotated delivery note and the photographs, as soon as possible and at the latest:
- for professional Customers: within three (3) days, excluding public holidays, following receipt, by registered letter sent to the carrier, in accordance with Article L. 133-3 of the French Commercial Code, with a copy to the Seller - failing this, any action against the carrier is extinguished;
- for consumer Customers: as soon as possible and preferably within three (3) working days, it being specified that the absence of reservations does not deprive the consumer of the benefit of the Seller's strict liability under Article L. 221-15 of the French Consumer Code or of the legal warranties referred to in Article 12. Compliance with these procedures nevertheless facilitates the rapid processing of the claim.
9.7 Failure to collect. Any goods not collected or refused without legitimate reason may be subject to invoicing of return, storage and handling costs, deducted from any refund.
Article 10 - Transfer of ownership and risk
10.1 Transfer of ownership is deferred until full payment of the price (Article 7.3).
10.2 In accordance with Article L. 216-4 of the French Consumer Code, for consumer Customers, any risk of loss of or damage to the Products is transferred when the Customer, or a third party designated by the Customer other than the carrier proposed by the Seller, takes physical possession of the Products. Where the Customer entrusts delivery to a carrier of their choice other than those proposed by the Seller, the risk is transferred upon handover of the Products to that carrier, in accordance with Article L. 216-5 of the same code.
10.3 For professional Customers, the risk is transferred upon handover of the Products to the first carrier.
Article 11 - Right of withdrawal
11.1 Principle. In accordance with Article L. 221-18 of the French Consumer Code, the consumer Customer has a period of fourteen (14) days to exercise their right of withdrawal without having to give reasons for their decision or bear any costs other than those provided for below. This period runs from receipt of the goods by the Customer or by a third party designated by the Customer. Where the order concerns several goods delivered separately, or goods consisting of multiple lots or parts delivered in stages, the period runs from receipt of the last item, lot or part.
11.2 How to exercise the right. The Customer notifies their decision to withdraw by means of an unambiguous statement, sent by email to contact@terrassexpert.com or by post to the address given in Article 2. The Customer may use the model form reproduced in the annex hereto, but this is not mandatory. The Seller acknowledges receipt of the withdrawal without delay on a durable medium and informs the Customer of the return address and the procedure to follow.
11.3 Return of Products. The Customer returns the Products without undue delay and no later than fourteen (14) days after communicating their decision to withdraw. The Products must be returned complete, in their original condition, not installed, not cut, not modified, and in packaging that allows them to be transported without damage - preferably the original packaging, properly palletised and film-wrapped. The Customer may be held liable for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning.
11.4 Return costs. The direct costs of returning the Products are borne by the Customer. Due to their nature (heavy, bulky and palletised goods), the Products cannot normally be returned by post. In accordance with Article L. 221-5, 2° of the French Consumer Code, the cost of returning them is estimated, for information purposes, according to the total weight of the goods returned, based on the following scale:
| Total return weight | Indicative cost incl. VAT |
|---|---|
| Up to 5 kg | €19.90 |
| From 5 to 10 kg | €23.90 |
| From 10 to 15 kg | €26.90 |
| From 15 to 20 kg | €29.90 |
| From 20 to 25 kg | €34.90 |
| From 25 to 30 kg | €39.90 |
| From 30 to 35 kg | €44.90 |
| From 35 to 40 kg | €49.90 |
| From 40 to 50 kg | €59.90 |
| From 50 to 60 kg | €64.90 |
| From 60 to 100 kg | €84.90 |
| From 100 to 150 kg | €139.90 |
| From 150 to 800 kg | €169.90 |
| From 800 to 5,000 kg | €259.90 |
These amounts correspond to the transport price scale applied by the Seller. They are expressed including all taxes for consumer Customers; professional Customers are invoiced on the basis of the same brackets, excluding VAT. They are given for information purposes and may vary depending on the geographical collection area, the accessibility of the pick-up location and the number of pallets concerned. For returns from a destination outside mainland France, islands not connected by a bridge, Corsica or the French overseas departments and territories (DROM-COM), a specific quotation is drawn up.
The Customer may, at their discretion, organise the return themselves with the carrier of their choice, at their own expense and under their own responsibility, or ask the Seller to organise collection: in the latter case, the corresponding cost is deducted from the amount of the refund.
11.5 Refund. The Seller refunds all sums paid, including the standard delivery costs initially invoiced (excluding any additional costs resulting from the choice of a delivery method more expensive than the standard method offered), no later than fourteen (14) days from the date on which it is informed of the decision to withdraw. In accordance with Article L. 221-24 of the French Consumer Code, the Seller may withhold the refund until it has received the Products back or until the Customer has supplied proof of having sent them, whichever is the earlier. The refund is made using the same means of payment as that used for the order, unless the Customer expressly agrees otherwise.
11.6 Partial withdrawal. The right of withdrawal may be exercised for all or part of the order. In the event of partial withdrawal, delivery costs are not refunded as long as part of the order is kept.
11.7 Exclusions. In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:
- goods made to the Customer's specifications or clearly personalised (in particular products cut, re-cut, machined or manufactured to order, special shades or formats specifically ordered);
- goods which, after delivery and by their nature, have been inseparably mixed with other items;
- goods unsealed by the Customer that cannot be returned for reasons of hygiene or health protection (in particular opened adhesives, mortars, resins and chemical products).
11.8 Professional Customers. The right of withdrawal does not apply to professional Customers, subject to Article L. 221-3 of the French Consumer Code, which extends it to professionals employing five or fewer employees where the subject of the contract does not fall within the scope of their main activity. The Seller may nevertheless agree, on a commercial basis and without being obliged to do so, to take back new, uninstalled goods in their original packaging, subject to prior written agreement and, where applicable, restocking fees specified in that agreement.
Article 12 - Legal warranties
Irrespective of any commercial warranty, the Seller remains bound by the legal warranty of conformity referred to in Articles L. 217-3 to L. 217-17 of the French Consumer Code and by the warranty against defects in the goods sold, under the conditions provided for in Articles 1641 to 1649 of the French Civil Code.
|
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared. The legal warranty of conformity entails a legal obligation to supply goods in conformity with the contract, failing which the seller may be held liable. The consumer may choose to request that the goods be brought into conformity by repair or replacement or, failing that, a price reduction or termination of the contract under the conditions provided for by law. The consumer is exempt from proving the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods. The legal warranty of conformity applies independently of any commercial warranty that may be granted. The consumer may decide to invoke the warranty against hidden defects in the goods sold within the meaning of Article 1641 of the French Civil Code. In this case, they may choose between termination of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code. |
12.1 Implementation. Any claim under the legal warranties must be sent to contact@terrassexpert.com, together with the order reference, a description of the defect and photographs. The Seller will then inform the Customer of the procedure to follow. The costs of returning non-conforming Products are borne by the Seller.
12.2 Exclusions. The following do not constitute a lack of conformity and are excluded from the warranties: normal wear and tear, the natural variations in shade and appearance referred to in Article 4.2, damage resulting from installation that does not comply with the manufacturer's recommendations and good trade practice (in particular French standard DTU 52.2 and applicable technical documents), from undersizing of the substrate or of the number of pedestals in relation to the loads, from inadequate water drainage, from abnormal use, from lack of maintenance, from modification of the product, or from an external event (impact, exceptional frost, storm, ground movement).
12.3 Manufacturer's warranty. Some Products benefit from a commercial warranty from the manufacturer, the conditions and duration of which are shown on the product page or in the attached technical documentation. This warranty applies without prejudice to the legal warranties.
12.4 Optional commercial warranty. The Seller may offer, as an option and on a strictly voluntary basis, a paid commercial warranty whose scope, duration, price and terms of implementation are detailed in a separate warranty contract, provided to the Customer on a durable medium before the order is concluded. No paid option is pre-selected by default, in accordance with Article L. 221-15 of the French Consumer Code.
Article 13 - Liability
13.1 The Seller acts as a distributor of materials and not as a builder, contractor or installer. It provides no design, structural sizing, installation or project management services and is consequently not bound by the legal warranties applicable to builders under Articles 1792 et seq. of the French Civil Code.
13.2 The advice, diagrams, installation guides and calculation tools made available on the Website are provided for information purposes only. It is the Customer's responsibility, where appropriate with the assistance of a qualified professional, to check the suitability of the Products for their project, the nature and load-bearing capacity of their substrate, the sizing of their structure, the load constraints, the applicable planning rules and compliance with good trade practice.
13.3 In accordance with Article L. 221-15 of the French Consumer Code, the Seller is strictly liable to the consumer for the proper performance of the obligations arising from the distance contract, unless it proves that the non-performance is attributable to the consumer, to the unforeseeable and insurmountable act of a third party unrelated to the contract, or to a case of force majeure.
13.4 With regard to professional Customers, the Seller's liability is limited to direct and foreseeable damage and may not exceed the amount of the order concerned excluding VAT. Indirect damage is excluded, in particular operating losses, loss of a project, loss of turnover, idle staff or late penalties incurred by the Customer vis-Ã -vis its own customers.
Article 14 - Force majeure
The Seller cannot be held liable for non-performance or delay in the performance of its obligations resulting from a case of force majeure within the meaning of Article 1218 of the French Civil Code and the case law of the French courts, in particular: natural disaster, exceptional weather conditions, fire, epidemic, armed conflict, blockage of means of transport, carrier strikes, widespread shortage of raw materials, or failure of telecommunications networks. The Seller informs the Customer of the occurrence of such an event as soon as possible. If the impediment is permanent, the contract is terminated and the sums paid are refunded within fourteen (14) days.
Article 15 - Personal data
The personal data collected in connection with orders are processed under the responsibility of JET Company as data controller. They are necessary for the management of orders, deliveries, invoicing and after-sales service and, subject to obtaining consent where required, for sending commercial communications. The Customer has the rights of access, rectification, erasure, restriction, objection and portability provided for by Regulation (EU) 2016/679 and the amended French Data Protection Act No. 78-17 of 6 January 1978. Full details of the processing are set out in the Privacy Policy.
Article 16 - Intellectual property
All elements of the Website (structure, texts, visuals, photographs, logos, trademarks, databases) are protected by intellectual property law and remain the exclusive property of the Seller or its partners. No transfer of rights is granted under these GTC. Manufacturers' brands and references are cited for the purpose of identifying the Products and remain the property of their respective owners.
Article 17 - Complaints, mediation and disputes
17.1 Customer service. Any complaint must first be sent to customer service: contact@terrassexpert.com - JET Company, 3 rue de la Boudrelle, 59181 Steenwerck, France.
17.2 Consumer mediation. In accordance with Articles L. 611-1 et seq. of the French Consumer Code, the consumer Customer may, after first attempting to resolve the dispute directly with customer service by means of a written complaint, refer the matter free of charge to the consumer mediator to which the Seller is affiliated:
The matter must be referred to the mediator within one year of the written complaint sent to the Seller.
17.3 European platform. Customers residing in the European Union may also use the out-of-court dispute resolution schemes accessible via the European Commission's portal dedicated to consumer disputes.
17.4 Applicable law and jurisdiction. These GTC are governed by French law. In the event of a dispute, and failing an amicable settlement, the French courts shall have jurisdiction. The consumer Customer may bring proceedings, at their choice, before any of the courts having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred. For professional Customers, exclusive jurisdiction is conferred on the Commercial Court of Dunkerque, notwithstanding multiple defendants or third-party claims.
Article 18 - Miscellaneous provisions
18.1 Partial invalidity. If one or more provisions of these GTC are held to be invalid or declared as such pursuant to a law, a regulation or a final decision of a competent court, the other provisions shall retain their full force and scope.
18.2 No waiver. The fact that the Seller does not invoke a breach by the Customer of any of the obligations herein shall not be interpreted as a waiver of its right to invoke it subsequently.
18.3 Language. These GTC are drawn up in French. In the event of translation, only the French version shall be authoritative.
